You agree that when using Third-Party Services, these will be subject to their own terms and conditions and any contract entered into or transaction completed is between you alone and the applicable third party.

Wicked Media LTD reserves the right to take whatever action it deems necessary or suitable (whether strictly legal, technical, or otherwise) to prevent their Services from sending out spam emails and to address complaints by third parties regarding such emails. Furthermore you agree that UPVOTE can suspend or end your account if there is suspicion of misuse for sending unsolicited mail.

UPVOTE offers service packages to help you increase the interaction of your posts on https://www.reddit.com/ (hereinafter “Reddit”), including but not limited to:

Create dialogical comments around the post’s content, thereby seeding it;

Create questions and answer them;

Create comments based on actual customer experiences.

Implementing services

The specific service package can be flexible according to the needs of you. You must send us your content that you want us to use to interact with your posts. We will review and have the right to ask you to edit content to align with Reddit’s policies.

For the implementation of your chosen services, you must also provide a list of posts and groups.

Information that is interactive

Before deploying work, Wicked Media LTD will review content based on Reddit’s policy.

Wicked Media LTD will complete your requested service within 24 hours of receiving your complete information.

You guarantee that your use of the Services will observe all laws and regulations, including any anti-spam or privacy laws relevant to you (the “Regulations”). These Regulations could include, but may not be limited to, CAN-SPAM, CASL and GDPR. It is solely your responsibility to determine whether the Services are in line with the Regulations. You understand and accept that UPVOTE cannot be held accountable for any inappropriate uses of the Services on your part that break the Regulations.

Property rights

Wicked Media LTD owns the Services and all related intellectual property rights. These Terms grant only limited rights with respect to the aforementioned, while all other rights are reserved. The use of Wicked Media LTD’s Trademarks is strictly prohibited without authorization.

If you send Wicked Media LTDany comments, ideas or Feedback relating to the Services, you grant us worldwide, unlimited, irrevocable and fully paid-up rights to use those for commercial or non-commercial purposes. This includes modifying, publishing and creating derived works of your Feedback. We can do this without any obligation on our part to pay you or anyone else.

You are solely responsible for any information and content (text, images, videos, audio, and other materials) uploaded, published, transmitted, linked-to or otherwise made available through the Services (“User Content”). UPVOTE is granted a non-exclusive, royalty-free, perpetual, irrevocable, transferable and worldwide licence to access, use, reproduce, modify, publish, translate, create derivative works from it; distribute it; disseminate it; perform; display; store; index and archive such User Content — in any form of media or technology — for the full term of any rights that may exist in such User Content. This is all so that they can provide their Services. When posting User Content generated by or on behalf of a third party you confirm that you are authorized to act on behalf of that third party and are binding them to these Terms.

The payment

If you have an account, you’ll be able to see our service fee. It will depend on the kind of package you intend to use and it’s listed on our website.

You will pay the service fee via a payment gateway such as Paypal, Stripe, or Unlimint…

We only refund you in the following cases:

Any of the terms and conditions in these terms have been violated;

We stop providing the service for which you have already paid.

Maintaining confidentiality

“Confidential Information” covers any information or materials of Wicked Media LTD that is reasonably considered to be confidential or proprietary, including, but not limited to; trade secrets, hardware and software (source code and object code), specifications, designs, plans, drawings, data, prototypes, discoveries, research and developments, processes and procedures; intellectual property; market research, marketing techniques and plans; business plans and strategies; pricing policies and price lists; financial information or other business/technical info. You agree to keep this Confidential Information safe and not use it for any purpose apart from using the Services.

Termination and Term

You can terminate your Wicked media ltd account anytime by going to https://upvote.shop/ or emailing contact@pepitoup.com. Wicked media ltd, however, reserves the right to suspend and cancel accounts at any moment with no warning or prior notice and no refund issued for the same. In case of cancellation without cause, though, Wicked media ltd will return any unused Credit remaining in your account.

Warranties are disclaimed

You acknowledge and accept that your use of the Services is at your own discretion, and that they are provided to you “as is” and “as available”. To the fullest extent permissible by applicable law, Wicked media ltd  disclaims all warranties of any kind, whether express, implied, statutory or otherwise, including without limitation, all warranties of merchantability, suitability for a specific purpose and non-infringement. Moreover, Wicked media ltd does not guarantee that the Services will meet your expectations or fulfill your needs; be constantly available; be secure; be accurate or complete; or contain no errors or defects. Additionally, Wicked media ltd specifically excludes from its responsibility or liability any Content made accessible through the Services (including Subscriber Content); third party products and/or services associated with or connected to the Services (such as Third Party Services); unauthorized access to or use of the Services; and any damage to software, computer systems or other properties due to viruses or malicious code resulting from access/use of the Services.

Liability Limitations

8.5 YOU ACKNOWLEDGE AND AGREE THAT THE ESSENTIAL PURPOSE OF THIS SECTION IS TO ALLOCATE THE RISKS UNDER THESE TERMS AND LIMIT THEIR POTENTIAL LIABILITY GIVEN THE FEES CHARGED FOR THE SERVICES, WHICH WOULD HAVE BEEN SUBSTANTLY GREATER IF Wicked media ltd WERE TO ASSUME ANY OTHER LIABILITY OTHER THAN AS SET FORTH HEREIN.

You are liable to defend, indemnify and shield Wicked media ltd from any accusations, activities or demands, consisting of but not restricted to fair legal and accounting fees, ascribed to: (i) your admittance or utilization of the Services or any User Content; (ii) your infringement of these Terms or the Acceptable Use Policy; (iii) your breach of any applicable laws, such as but not restricted to anti-spam or privacy statutes ;or (iv) your wrongdoing of any outsider right, including however not restricted to any mental property, protection or exclusive right, or obligation of confidentiality. You will use your best efforts to collaborate with Wicked media ltd in the defence of any allegation. Wicked media ltd has the authority, at its own expense, to take control over matters expected to be indemnified by you.
